1. Course objective

1. Mụctiêuđàotạo

The course aims to build knowledge and critical thinking of students on the concepts and implications of certain human rights in the judicial field, how to ensure these rights through the actions of the subjects such as the courts, procuracies, investigating bodies and officials.

Môn học này nhằm giúp học viên có các kiến thức và tư duy phản biện về các khái niệm và nội hàm của một số quyền con người trong lĩnh vực tư pháp, cách thức bảo đảm các quyền này thông qua hoạt động của các chủ thể có liên quan như tòa án, viện kiểm sát, cơ quan điều tra cùng những cá nhân có thẩm quyền.

1.          Overview of rights in the judicial sector, the right to fair trial

2.          A number of standards for subjects involved in the proceedings (prosecutors, judges, lawyers)

3.          The right to freedom, personal security, the right to be free from torture,

4.          Human rights in investigation, prosecution, rights of the deprived person

5.          Right to counsel

6.          Human Rights in the Trial Period

7.          Justice and judicial independence

8.           Compensation of wrongful consequences

Học phần này bao gồm các nội dung cơ bản dưới đây:

1.      Khái quát về quyền trong lĩnh vực tư pháp, quyền về xét xử công bằng

2.      Một số tiêu chuẩn về các chủ thể tiến hành và tham gia tố tụng (công tố viên, thẩm phán, luật sư)

3.      Quyền tự do, an toàn cá nhân, quyền không bị tra tấn,

4.      Quyền con người giai đoạn điều tra, truy tố, quyền của người bị tước tự do

5.      Quyền bào chữa

6.      Quyền con người trong giai đoạn xét xử

7.      Tư pháp và độc lập tư pháp

8.      Bồi thường và khắc phục hậu quả của oan sai
